  如今说到家电,我们脑子里出来第一个家电品牌应该就属美的了,要知道美的是1968年初创,80年才开始涉足家电,93年上市,到如今就已经走进了中国几乎每一个家庭。不得不说,美的是好样的!

  这种成功的背后其知识产权部署出了很大一份力。美的依托于技术全球化的大规模投入、内生式专利研发和海外知识产权风控流程的加持,发明专利数量连续三年稳居全球第一。

  据世界知识产权组织数据显示,中国2016年的国际专利申请量世界第三。截至2016年度,美的集团累计国内专利申请量突破5.4万件,授权维持量2.7万件,并将约7500件收购知产进行转化与融合。

  一直把技术创新放在首位的美的集团,在过去五年中累计技术研发上的投入达200亿人民币。2016年美的研发人员整体超过10000人,专利团队有超过90位专利工程师,均有10年甚至15年以上的工作经验。在建设自主研究团队之余,还请了大量“外援”,与近100家世界级知名高校、研究机构及科技公司建立深度技术合作。

  据科睿唯安发布的《2017全球创新报告:进无止境》显示:在家电领域,美的发明的专利数量连续三年稳居全球第一,同时美的在家用电器和厨房电器两项专利量均名列榜首。目前美的已在全球建立20个研发中心。真正的全球化不仅仅是品牌的全球化,还是技术研发的全球化。

  近年来,中国家电企业正在加快争夺话语权,与曾经低成本优势推动产品出口不同,如今在科技创新领域的硬实力已经成为中国家电企业的新王牌。美的整体业务迈向海外也更加多样化,从以前的传统家电,现在进入到机器人领域,进入到智慧家居领域,尤其对于这些领域来说是知识产权紧密型的行业。

  美的集团全球研发中心成立了中央研究院,并形成四级研发体系,其中事业部定位1-2年的新品开发和2-3年个性技术研究,中央研究院定位3-5年中长期共性技术研究及5年以上的基础研究、颠覆性研究。

  美的现在的专利申请主要还是内生式的,超过90%的专利都是自己的原创。美的前期投入了大量资源,所以至少在未来一段时间专利来源还是以内生为主,并购获得知识产权为辅。所以,美的拥有的知识产权价值是在保护自己的业务,使得这个专利最终体现在产品当中,实现技术或者专利的价值。

  另一方面,海外知识产权风控就像和对手进行一场博弈,除了要有好的武器(高质量专利),更重要的点就是排兵布阵,用什么样的兵法,其实就是怎样进行专利布局。随着美的在海外市场加速扩张,风险也逐渐突出,美的知识产权团队不断做出调整和变化。

  以厨电“蒸汽洗”技术为例,申请注册了带喷管的油烟机专利,并同时申请了喷管的喷射角度、形状、防止堵塞等等专利,仅这一个小小的专利周边就布局有十件专利。一个基础专利周围有很多的外围专利,这样的布局能有效把其他的竞争对手挡在“围墙”外面。

  目前美的有10个事业部、多家中央研究院和智慧家居研究院。同时,每个事业部都有专门的知识产权团队,人员数量从2个到15个不等。美的有一半的营收来自于海外,所以专利纠纷是无法避免的,最好的手段就是做好海外知识产权风控,积攒更多更好的专利武器,就将拥有更多话语权。

Furthermore, one of the patents relates to personalized sound technology, helping players with hearing issues by modifying or creating music based on their preferences (patent No. US 10790919).   The code of the mentioned technology is published on EA’s GitHub, and it is open to all developers. Thus, the developers can use it or adapt it for their games without spending the costs to research. It is good that EA shares the patents for free use and aims to create an accessibility-increased gaming environment for players. However, it is not “unconditional” to use the listed patents. In the pledge, EA mentioned that it may terminate the promise for a specific party which files a patent infringement lawsuit or other patent proceedings against EA.
