  起诉事件

  家住广州的消费者李先生称,去年5月他花2万多元购买了一款型号为HPA-80A2的A.O.史密斯热泵电热水器,但直到今年9月为止仍不能正常使用。李先生多次拨打A.O.热水器售后服务部门电话,要求上门解决问题,对方也上门数次进行维修,却声称该事故与他们没有关系,这件事前前后后拖了一年多。当时A.O.史密斯的经销商张先生也表示确有其事,但他强调是管路铺设的问题,与产品无关。对此李先生反驳称,当初装修公司就是在A.O.史密斯工作人员的指导下铺设管路的。由于双方僵持不下,李先生家的问题迟迟未能得到解决。

  因为屡次沟通未果,李先生将此事投诉到了广州市消委会。今年10月底,李先生告诉北京商报记者,热水器问题已经得到解决。原因是在多次催促后,A.O.史密斯的工程师到他家里检查,拆开后发现是设备没有调试好,管理循环的中央泵出了问题。但是,直到现在,A.O.史密斯方面也没有给李先生一个说法,承认是自己的失误。

  对于这起投诉,北京商报记者也通过电话、短信和邮件的方式联系了A.O.史密斯的相关负责人,但截至发稿,对方并未做出任何回复。

  其实,对于A.O.史密斯的产品指控并不只此一例。据北京晚报报道,家住北京的夏女士2010年购买了A.O.史密斯燃气热水器一台,但是在刚安装的时候这台热水器就无法正常使用,任何档位都打不着火。在售后多次维修之后,热水器则彻底不能使用了。

  A.O.史密斯公司的回复则是建议折旧购买新机,新机可以按7折价格进行购买。夏女士表示不能接受这个方案。她认为,A.O.史密斯公司广告宣传说产品可以用一个世纪,现在她家的燃气热水器未使用就出现故障,年年要修,六年就出现配件不生产的情况,这是公司极其不负责任的表现,广告也涉及虚假宣传。

  美国身份

  多年来,A.O.史密斯一直宣称自己是“美国热水专家”。据A.O.史密斯相关负责人介绍,公司产品在美国的市场占有率达到了40%以上。但对于该公司自称的“北美最大的家用和商用热水设备及锅炉制造商之一”,业内却存在不少质疑之声。

  南京华讯指出,A.O.史密斯所谓的“美国热水专家”称号并不符合事实,在美国,A.O.史密斯仅是一家以生产儿童座椅、童车起步的小型制造公司,生产电热水器的历史不足60年,更别提燃气热水器和净水设备。就是电热水器,随着欧美电热市场的没落,目前也已基本转型为一家建筑设备和电动工具生产商。

  北京商报记者日前走访朝阳区某苏宁卖场时,该卖场A.O.史密斯的导购员表示,A.O.史密斯热水器并非是进口产品,因为如果是全部原装进口,也不一定适合中国的水质。

  在业内人士看来,外资品牌进入中国市场必走的一条路就是本土化,比如三星、LG等,但A.O.史密斯却反其道行之,在宣传上一直狂打“美国牌”。以其新推出的全系列金圭内胆空气能热水器为例,A.O.史密斯称:“该产品采用的焊接技术已经成为核心技术,这种核心技术可以让A.O.史密斯专利金圭内胆达到美国标准(2.0MPa),远高于中国及欧洲标准(1.2MPa)。”

  A.O.史密斯的导购员也表示,A.O.史密斯都是采用的美国专利和美国技术。“A.O.史密斯是美国独资品牌,是针对中国的水质而打造的,专门打造的金圭内胆防腐蚀,抗十年水垢。” 北京商报记者在热水器上也看到了贴有金圭防护系统的标语。对于A.O.史密斯采用美国标准和美国专利的说法,导购员则表示,美国的标准更高、更严,以水箱承压指标(水箱加压疲劳试验)举例,中国标准只要10万次就合格了,而国外则是16万次的标准。

  对此,国内某家电企业负责专利业务的负责人告诉北京商报记者,对于家电企业来说,拥有一项国家专利技术,特别是发明专利,是对其技术研发实力的一种认可和肯定,同样,多年来A.O.史密斯也正是借助美国专利技术,推销其电热水器,彰显自身技术实力。

  “但专利权是一个国家和政府授予发明创造的‘法律独占权’,所以这个权利有效的前提,就是在该国范围内。也就是说,任何一个专利都是某个具体国家的专利,并且它只在该国有效,任何人在其他国家都可以无偿使用。”上述负责人如是说。

  失效专利

  在上月举办的中国国际厨房博览会上,A.O.史密斯发布了2016年防一氧化碳中毒的燃气热水器新品,并宣称:“3款新品全部搭载有A.O.史密斯创新研发的美国专利一氧化碳安全防护系统。”

  据北京商报记者了解,A.O.史密斯也在国内对上述系统进行了专利申请。不过,A.O.史密斯的一氧化碳安全防护系统专利在国内已经失效。对此,上述专利负责人也向北京商报记者证实了这一情况。据了解,去年4月,中国国家知识产权局专利复审委员会就在官网发出决定,A.O.史密斯一氧化碳报警器专利不具备专利法规定,宣告该专利权无效。然而,北京商报记者在终端卖场仍然可以看到A.O.史密斯“产品能监测CO”的宣传语。

  一位在热水器领域从业十多年的业内人士更是指出,A.O.史密斯所谓的“美国热水专家”和美国标准其实意义不大。首先,美国以前是以电热水器为主,近年来因为节能法规,电热水器已不允许生产和销售。其次,美国和中国燃气热水器存在本质区别,美国一般所使用的都是锅炉式,用于整个家庭用水。中国则是大多采用即热式燃气热水器。“A.O.史密斯是2005年找日本能率代工,才开始销售即热式燃气热水器,三年后开始自己生产。所以准确地说A.O.史密斯的即热式燃气热水器技术是来源于日本,而非美国。”该人士表示。

  “我在美国从来没有听说过A.O.史密斯这个品牌,只是在国内看到过它的广告。在美国,家家户户都是靠燃气小锅炉来制热、制冷。”一位定居美国并代理美国某空气净化器品牌的刘先生透露。

  由于A.O.史密斯打上了美国标签,热水器产品价格也水涨船高。北京商报记者在卖场中对比发现,A.O.史密斯产品整体价格要远高于同行,基本上电热水器价格在四五千元,燃气热水器更是动辄七八千元。11月2日,北京商报记者在苏宁卖场中看到,其60升的电热水器EWH-60E10售价5088元,20升燃气热水器JSQ40-HX售价8728元。而国产海尔、美的等同尺寸产品,售价普遍在2000元左右,甚至还有千元以下的产品。

  尽管饱受质疑,但A.O.史密斯的市场表现还是不错的。市场研究机构中怡康的零售监测数据显示,2016年6月,A.O.史密斯在国内热水器市场所占份额达到16.4%,排名第三,仅次于海尔和美的。而得益于高售价,中怡康公布的最新一周(2016年10月23日-29日)的线下零售额数据显示,A.O.史密斯以24.4%的份额位列第一。
