杜比实验室对于电影爱好者来说一定不陌生,杜比全景声和杜比视界,对电影音响和家庭音响产生了巨大的影响。杜比实验室作为全球科技巨头,拥有影音领域的诸多专利,国内的小米、中兴通讯等公司都曾与杜比达成相应的专利合作。而作为知名的国产手机厂商,OPPO近几年的发展是有目共睹的,在2017年三季度中国手机销售排行榜中,OPPO曾以18.9%的市场占有率问鼎榜首。

OPPO正在积极地进行全球的市场布局,在全球建立了6个研发中心,并在欧洲、美国等超过40个国家和地区进行专利布局,全球专利申请量已经超过2万件,并已经获得了5500项授权专利。除了此次花数十亿购入杜比实验室的专利,今年初,OPPO一次性购买了来自英特尔的37项美国专利组合;此外,OPPO今年还从夏普获得了三项移动通信系统、移动台设备和通信方法领域的美国专利。而OPPO的专利申请和授权专利主要集中在拍照、旋转摄像头、VOOC闪充、外观设计等领域。

可以看出,OPPO现在已经成为最为积极的海外专利买家。OPPO与杜比实验室也达成了比较紧密的合作关系,当然这个过程也不是一蹴而就的。实际上,OPPO在印度市场上曾经与杜比产生过专利纠纷。201611月,杜比将OPPOvivo告上印度法庭,称这两家公司的手机产品侵犯其专利权,要求支付专利费。 随后,印度德里高等法院裁定,要求OPPOvivo按照每部手机34卢比(约合人民币3.43元)的价格向杜比实验室支付专利费用。不过在法庭做出进一步判决之前,两家公司仍可以制造、销售和进口他们的产品。据悉,OPPOvivo案的主要被告分别是印度本地公司GDN EnterprisesDAS Telecom20171230日,杜比的律师称,杜比与两位被告签订了一项战略合作协议2018118日,杜比撤销了针对OPPO(主要被告为GDN Enterprises)的诉讼。321日,OPPO官方宣布与杜比实验室正式建立全球性知识产权战略伙伴关系,双方将在杜比HE-AAC以及其他音频、视频和JPEG-HDR技术领域展开共赢合作。就在OPPO和杜比宣布达成合作伙伴关系的10天后,杜比便转让给OPPO 55项专利技术。

IAM透露,在此次杜比转让给OPPO240项专利中,还涉及到德国、法国、意大利和英国,这也与OPPO目前的全球化策略相符,OPPO正在积极拓展欧洲市场。此次OPPO与杜比实验室进行专利合作,一方面意在弥补其在相关领域的技术短板,另一方面,获奖通过此举不断累积自身技术实力和专利储备,为进一步拓展海外市场积蓄实力。
