Preface of Chinese Version
Behavioral science tells us again that people are animals that seek advantages and avoid disadvantages. It is this quality that makes regulation (regulation) possible, and by regulating the proper setting of carrot and stick (carrot and stick), society can be guided in the direction set by the government. This is why the rule of law is so important in modern countries.
Whether it was the TPP(The Trans-Pacific Partnership TPP) or the current Sino-US trade war, intellectual property rights are the core disputes. If mainland China really wants to fundamentally solve the foreign criticism of our intellectual property rights and guide domestic enterprises to upgrade their technology, the innovation of the intellectual property legal system may be the best way. This book is the research output under this background, trying to answer how to promote the modernization of China's pharmaceutical industry through the innovation of intellectual property legal system. The main reason for choosing the pharmaceutical industry as the research object is that, referring to the experience of Europe and the United States, the pharmaceutical industry is the most sensitive industry to the intellectual property system, that is to say, any adjustment of the intellectual property legal system will have a significant impact on the development of the pharmaceutical industry. The adoption of Hatch Waxman Act in the United States has really created the American generic drug industry, which is the best example.
This book is published in simplified form in mainland China. I would like to thank Zhuang Jingzhi, a lawyer from Taipei Qingchen Law Firm, for his careful review and Miss Xu Yarong of Nanjing Huaxun Intellectual Property Consulting Co., Ltd. for her coordination.
