After two years, known as the "Internet patent first case" Sogou Baidu input method patent war is finally coming to an end.
On September 14, Sogou v. Baidu series of input method patent infringement cases, the Beijing Intellectual Property Court officially entered the hearing stage. The claim amount in this case is 10 million RMB, which is the only case that has been accepted in court among the seven Sogou v. Baidu input method patent infringement cases pending by the Beijing Intellectual Property Court.
The origin of the matter can be traced back to 2014. In August of that year, Baidu appealed against the "search candidate service" of sogou input method, automatically skipping Baidu search and directly entering the search results page of sogou, which constituted unfair competition and claimed 1.2 million yuan. In October 2015, the Beijing Haidian Court issued a first-instance judgment on him, demanding that Sogou immediately stop the behavior and compensate 500000 yuan.
Since then, the dispute between the two Internet giants has been out of control. Before the end of October, sogou countersued Baidu and sued the Beijing Intellectual Property Court, claiming that its "Baidu input method" products infringed eight patents related to input method technology owned by sogou and claimed 80 million yuan. In November, Baidu was sued to the Beijing Intellectual Property Court, the Shanghai Intellectual Property Court and the Shanghai Higher People's Court, claiming that Baidu's input method infringed on its nine patent rights, with a total claim of 0.18 billion yuan.
Of course, Baidu is not a vegetarian. Since then, Baidu has filed a patent invalidation request with the Patent Reexamination Board of the State Intellectual Property Office for the patent involved. Then in October 16, Baidu sued sogou to the Beijing Intellectual Property Court, claiming infringement of as many as 10 technical patents of Baidu input method and demanding compensation from sogou for a total of 0.1 billion yuan. So far, this patent war has become the first case of China's Internet patent.
Up to now, the number of patents that have been invalid or partially invalid in Sogou has reached 12. For this reason, Sogou has successively withdrawn 8 prosecutions. With this case officially entered the trial, a real PK kicked off.
If the case is won, Sogou will be supported by the corresponding infringement award. This will not only affect the strength of judicial protection of Internet-related patents, but also affect the balance between Internet technology innovation and intellectual property protection.
